By booking a session, class, or circle, or by using this website, you agree to these terms. Read them alongside the Policies & Disclaimer page and the Privacy Policy, all three together govern working with this practice. These terms can change; if they do, the effective date at the top of this page moves, and continuing to use the site or book afterward means you accept the update.
Who this is for
This practice is intended for adults 18 and older. By booking, you're confirming you meet that requirement.
What's being offered
Private phone sessions, group healing circles, and live classes, all spiritual and intuitive in nature. None of it is medical, psychological, or veterinary care, and none of it is offered as a substitute for that care. The full medical disclaimer, including how this practice's healing work is described and why, is in the Policies & Disclaimer page; it applies in full here and isn't repeated in detail on this page. Sessions booked through this site are by phone; if you ever attend an in-person class, workshop, or session with Malana, these terms and that disclaimer apply there just the same.
Booking, payment, and refunds
Sessions and classes are booked and paid for at the listed price at the time of booking. The rescheduling, missed-call, and refund terms in the Scheduling & refunds section apply to every booking. Payment is processed by Stripe; any dispute over how a charge was processed is between you and that provider under their own terms.
Your responsibilities
You agree to give accurate contact and payment information, to be reachable at your booked time, to use this site and these services lawfully, and to treat Malana with the same respect you'd expect in return. Ongoing medical or mental health care, and decisions about it, remain your responsibility and your treating provider's, not this practice's.
Limits on liability
This work is offered as described in the Policies & Disclaimer page: results vary, and no specific outcome is promised. It's provided as it is, without any warranty, express or implied, that it will produce a particular result for you.
To the extent allowed by law, this practice's liability for any claim arising from a session, class, or circle is limited to the amount you paid for that particular session, class, or circle, and this practice isn't liable for indirect or consequential loss arising from your use of its services.
Holding each other harmless
By using these services, you agree not to hold Malana responsible for claims, losses, or costs arising from your own use of a session, class, or circle, except where they result from her own negligence or misconduct. This isn't meant to waive any right the law doesn't allow to be waived.
Declining or ending service
Malana can decline to book, or end, a session, class, or circle with anyone, including for conduct that's abusive, unsafe, or otherwise a poor fit, separate from the "honest endings" described in the Policies & Disclaimer page, which is about whether the work itself is helping. If she ends a session early for this reason, the refund terms still apply.
Intellectual property
The words, class materials, and teachings on this site and shared during a class are Malana's own. They're offered for your personal use, not for republishing, teaching to others, or reselling without her permission.
Third-party services
Booking runs through Cal.com; payment runs through Stripe. Each operates under its own terms and privacy policy, this practice isn't responsible for how those services perform, and using them means you've also agreed to their terms.
If there's a disagreement
If something goes wrong, reach out first through the contact page so it can be worked out directly. If it can't be resolved that way, either side may bring the matter to small claims court in Bernalillo County, New Mexico. Any claim is brought individually, not as part of a class, group, or combined action with anyone else's claim.
Governing law & changes to these terms
These terms are governed by the laws of the State of New Mexico, where Malana is based, without regard to conflict-of-law principles.
If these terms change in any meaningful way, the effective date at the top of this page will be updated. Checking back here is the way to see the current version.
The fine print
These terms, together with the Policies & Disclaimer page and the Privacy Policy, are the whole agreement between you and this practice, they replace any earlier version of these pages. If any one part of them turns out not to be enforceable, the rest still stands. This agreement is personal to you and can't be transferred to anyone else; if this practice is ever transferred to someone else, these terms transfer with it.
